NA scrutinizes the draft Law on Road Traffic Order and Safety

Under the authority of Prime Minister, General To Lam, Minister of Public Security, member of the Politburo, Minister of Public Security presented the Statement on the draft Law on Road Traffic Order and Safety at the National Assembly (NA) on October 24.

The review of the 10-year implementation of the Law on Road Traffic (2008) shows that the Law regulated two different areas: road traffic order and safety; road traffic infrastructure and transportation.

General To Lam speaks at the NA.

However, road traffic order and safety belong to the fields of security, social order and safety while the development of transport infrastructure involves the economic and technical fields.

These two areas have different targets and subjects, in which road traffic order and safety regulations aim to ensure security and safety for people participating in the traffic. On the other hand, the development of transport infrastructure facilitates socio-economic development, ensure the technical safety of traffic structures.

Therefore, there must be an independent law to regulate the field of road traffic order and safety.

* Improving the quality and efficiency of State management of traffic safety.

Minister To Lam emphasized that the purpose of the draft Law is to ensure safety for the people's lives and health, to ensure human rights and citizenship according to the Constitution.

The draft Law is consistent with the Party's guidelines, concretize the Constitution’s provisions, and ensure the uniformity of the legal system. It is also compatible with relevant international treaties to which Vietnam is a member.

Minister To Lam said that the draft Law is presented to the National Assembly after the draft Law on Road Traffic (revised) has been studied and evaluated carefully on the basis of practical surveys. The process of developing the draft Law on Road Traffic Safety Security has received high consensus from ministries, branches and government members.

With the two independent laws: The Law on Road Traffic Order and Safety and the Law on Road Traffic (revised), the quality and efficiency of State governance over both road traffic safety and transport infrastructure development.

* It is necessary to issue the Law on Road Traffic Order and Safety.

At the NA, Senior Lieutenant General Vo Trong Viet, Chairman of the NA Committee for National Defense and Security presented the evaluation report on the draft Law on Road Traffic Order and Safety, stating that the Committee basically agreed that it is needed to issue the draft Law as it is in line with the Party Secretariat's directions and international treaties. In addition, the draft Law can overcome shortcomings in State governance over road traffic order and safety.

Good management of the responsibility for training, conducting tests and issuing driver’s licenses to citizens also helps prevent and reduce traffic accidents and traffic law offences. Therefore, these contents must be included in the Law on Road Traffic Order and Safety.

Regarding the classes of driving licenses, Vo Trong Viet said that the draft Law with 11 classes of driver’s licenses is consistent with the 1968 Convention on Road Traffic. However, all the types of driver’s licenses issued under the Law on Road Traffic (2008) are still valid (Clause 3, Article 71) until they expire. The re-issuance of the old driver’s licenses will follow the new provisions of this Law (Clause 2, Article 71) so it wills not affects the rights of drivers.
