According to Hoang Quyet Tien, Chairman of An Sinh Joint Stock Company (JSC), the lawsuit was handled by the Hanoi People's Court on May 4. In addition, the Directorate for Roads of Vietnam and Dai Tin Joint Stock Commercial Bank’s Hanoi branch and Vietnam Maritime Commercial Joint Stock Bank’s Quang Ninh branch are also involved parties in the lawsuit.
In the lawsuit, An Sinh JSC requests the Court to cancel Decision No. 4703 / QD - BGTVT issued on 31 December 2015 by the Minister of Transport on buying the franchise of the Hoang Mai toll station, located on National Road 1, Nghe An province, and the Bai Chay toll station on National Road 18 in Quang Ninh province.
An Sinh JSC, which had invested in the road sections and then operated the two toll stations, requests the Court to cancel Decision No. 4703 / QD - BGTVT issued on 31 December 2015 by the Minister of Transport. |
According to Decision No. 4703, the franchise prices of the two toll stations are 321,032 billion VND, of which the Hoang Mai station costs 114,88 billion VND and Bai Chay station is 206,152 billion VND.
However, representatives of An Sinh JSC said that the prices are lower than the actual appraisement, causing loses to the company.
In 2009, the Directorate for Roads of Vietnam (DRV) signed a contract with An Sinh, according to which DRV franchised the Bai Chay toll station and Hoang Mai toll station at 322 billion VND and 225 billion VND to the company. Accordingly, the company was permitted to collect tolls at the two stations from 0.00 hour, January 1, 2009 to 0.00 hour, January 1, 2014.
In 2013, the Prime Minister decided to eliminate road toll stations so DRV started negotiating with An Sinh to re-buy the two toll stations.
On October 16, 2013, the two sides reached agreement to stop operation of the two toll stations, and An Sinh asked DRV to pay 172 billion VND for the Hoang Mai and 288 billion VND for the Bai Chay.
But Decision No. 4703 has not met their requirements. That is why An Sinh continuously raised the issue to DRV, and now it has brought the case to court.
