MPS signs joint circular on criminal procedure with other ministries

The Ministries of Public Security (MPS), Defense, Finance, Agriculture and Rural Development and the Supreme People’s Procuracy (SPP) held a ceremony to sign a Joint Circular guiding the implementation of a number of provisions of the law amending and supplementing the Criminal Procedure Code 2015” on November 29.

Lieutenant General Nguyen Duy Ngoc, Member of the Party Central Committee and Deputy Minister of Public Security, chaired the event.

The signing ceremony also saw the presence of Senior Lieutenant General Le Huy Vinh, Member of the Party Central Committee, Deputy Minister of Defense, Deputy Prosecutors-General of the SPP Nguyen Huy Tien and Nguyen Duy Giang, Deputy Minister of Finance Vu Thi Mai, Deputy Minister of Agriculture and Rural Development Nguyen Hoang Hiep.

At the ceremony, Major General Pham Cong Nguyen, Director of Legal Affairs and Administrative, Judicial Reforms Department under the MPS and Ms. Hoang Thi Quynh Chi, Director of the Department of Legal and Scientific Management under the SPP briefed delegates at the event on the basic contents of the draft Joint Circular amending and supplementing the draft Joint Circular No. 01/2017.

Leaders of the ministries and the SPP signed a new Joint Circular.

The law amending and supplementing articles of the Criminal Procedure Code (referred to as the law) was adopted at the 2nd session of the 15th National Assembly on November 11, 2021.

The law, which will officially come into effect on December 1, 2021, has made amendments and supplements to the regulations on the responsibility of “preliminary investigation and verification” of crime reports and denunciations by entitling the communal police force to the responsibility, and additional grounds for suspending the case due to natural disasters and epidemics, said Deputy Minister Nguyen Duy Ngoc.

For better implementation of the Law, the MPS coordinated with relevant ministries and branches to develop a draft Joint Circular amending and supplementing a number of articles of the Joint Circular 01/2021/TTLT-BCA-BQP-BTC-BNNPTNT-VKSNDTC signed by the ministries and the SPP guiding the implementation of the 2015 Criminal Procedure Code on receiving and handling criminal reports, denunciations as well as proposals for prosecution.

The deputy minister hoped that leaders of ministries would continue to closely coordinate with the MPS in completing the system of legal documents as well as in other aspects of work, creating favorable conditions for the MPS to accomplish its tasks of protecting national security, maintaining social order and safety, contributing to the country's socio-economic development.

At the event, leaders of the ministries and the SPP signed a new Joint Circular.
